Terms of Use and User Content Policy

1. 適用範圍與同意 / Scope and Acceptance

歡迎使用Bilingual Chat（以下稱「本服務」），由雲啟數位（以下稱「本公司」）提供。使用或存取本服務，即表示您已閱讀、理解並同意受本「使用條款與用戶內容政策」（以下稱「本條款」）約束。
若您不同意本條款之任何內容，請勿安裝、存取或使用本服務。

Welcome to Bilingual Chat (the “Service”), provided by ICoud Start (the “Company”). By installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and User Content Policy (the “Terms”).
If you do not agree with any part of these Terms, you must not install, access, or use the Service.

2. 年齡限制 / Age Requirement

本服務僅提供給年滿 18 歲之使用者。使用本服務即表示您聲明並保證自己已年滿 18 歲。若您未滿 18 歲，請勿使用本服務。

The Service is intended only for users who are at least 18 years old. By using the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you must not use the Service.

3. 服務說明（匿名聊天室與暫時性房間）
Service Description (Anonymous Ephemeral Chat Rooms)

本服務提供匿名聊天室功能：
・ 使用者可建立聊天室，並透過邀請碼讓他人加入。
・ 使用者無需註冊帳號，本服務會根據裝置識別資訊建立一次性帳號。
・ 聊天室具有有限生命週期，目前設定為自建立起約 2 小時；
・ 系統層面的聊天記錄將在約 3 小時內自動刪除或無法再被存取。
儘管本服務採取暫時性儲存機制，您在聊天室中傳送的任何內容，仍可能在聊天室存續期間讓多名使用者同時看見，請謹慎發言。

The Service provides anonymous chat room functionality:
・ Users can create chat rooms and invite others via an invitation code.
・ Users are not required to register an account; the Service creates a one-time account based on device identifiers.
・ Each chat room has a limited lifetime, currently around 2 hours from creation;
・ System-level chat logs are automatically deleted or become inaccessible after approximately 3 hours.
Although the Service uses an ephemeral storage model, any content you send may be visible to multiple participants during the lifetime of a room. Please communicate responsibly.

4. 禁止內容與零容忍政策
Prohibited Content and Zero-Tolerance Policy

本服務對於違反本條款之不當內容與濫用行為採取零容忍態度。您同意不在本服務中創建、傳送、分享或散布下列任何內容，包括但不限於：
1. 色情或性露骨內容，特別是涉及未成年人的任何性相關內容；
2. 仇恨言論：針對種族、民族、國籍、宗教、性別、性傾向、性別認同、年齡、身心障礙等群體的侮辱、貶低或煽動仇恨的內容；
3. 暴力或威脅：鼓勵、描繪或威脅暴力行為、恐嚇他人、煽動他人實施傷害行為；
4. 自殺或自殘相關：鼓勵、宣傳或美化自殺、自殘等行為的內容；
5. 騷擾或霸凌：重複性攻擊、辱罵、跟蹤、恐嚇、羞辱或其他形式的人身攻擊；
6. 非法活動：宣傳、教唆或協助任何違法行為，包括但不限於毒品、詐騙、駭客攻擊、洗錢等；
7. 兒少性虐待、剝削或任何涉及未成年人之不當內容；
8. 垃圾訊息或惡意連結：大量重複訊息、釣魚網站、惡意軟體、詐騙連結等；
9. 侵犯第三人智慧財產權或隱私權的內容；
10. 其他本公司合理判斷為不適當、不安全或違反適用法律法規的內容。

如本公司發現或接獲檢舉上述內容，本公司有權立即移除相關內容，並依情節嚴重程度限制或終止相關使用者對本服務的使用。

The Service has a zero-tolerance policy toward objectionable content and abusive behavior. You agree not to create, transmit, share, or distribute any content through the Service that includes, but is not limited to:
1. Pornographic or sexually explicit material, especially any sexual content involving minors;
2. Hate speech targeting groups based on race, ethnicity, nationality, religion, gender, sexual orientation, gender identity, age, disability, or similar characteristics;
3. Violence or threats, including encouragement, depiction, or threats of violence, intimidation, or incitement to harm others;
4. Content that promotes, glorifies, or encourages suicide or self-harm;
5. Harassment or bullying, including repeated attacks, insults, stalking, intimidation, or other forms of personal abuse;
6. Illegal activities, such as promoting or facilitating drugs, fraud, hacking, money laundering, or other unlawful behavior;
7. Child sexual abuse material, exploitation, or any inappropriate content involving minors;
8. Spam or malicious links, including mass unsolicited messages, phishing sites, malware, or scam links;
9. Content that infringes the intellectual property or privacy rights of others;
10. Any other content that the Company reasonably deems inappropriate, unsafe, or in violation of applicable laws or regulations.

If the Company becomes aware of or receives reports regarding such content, we may promptly remove the content and, where appropriate, restrict or terminate the offending user’s access to the Service.

5. 用戶行為規範 / User Conduct

您同意負責管理自己在本服務中的行為，並不得：
・ 假冒他人或不實聲稱與任何個人或機構具關聯；
・ 利用本服務對他人進行騷擾、恐嚇、霸凌或散布仇恨；
・ 嘗試破壞服務運作、進行駭客入侵、逆向工程或其他未經授權的存取；
・ 利用本服務散播病毒、惡意程式或其他破壞性程式碼；
・ 以任何方式違反適用法令或本條款。
本公司有權依自身合理判斷，對違反本條款之行為採取措施，包括但不限於刪除內容、限制功能、暫停或終止使用者使用本服務。

You are solely responsible for your conduct while using the Service, and you agree not to:
・ Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation;
・ Use the Service to harass, intimidate, bully, or spread hate toward others;
・ Attempt to disrupt the Service, hack, reverse engineer, or access the Service without authorization;
・ Distribute viruses, malware, or other harmful code through the Service;
・ Violate any applicable laws, regulations, or these Terms in any way.
The Company may, at its reasonable discretion, take actions against violations, including but not limited to removing content, limiting features, suspending, or terminating a user’s access to the Service.

6. 檢舉機制與處理時效 / Reporting Mechanism and Response Time

本服務提供檢舉功能，使用者可在聊天室中選擇「檢舉訊息」或類似選項，回報認為不當的內容或行為。
檢舉內容可能包含：訊息識別碼、聊天室識別碼、被檢舉使用者識別資訊、檢舉人識別資訊、檢舉原因與時間等。

本公司將於合理可行範圍內，在收到檢舉後 24 小時內審查相關內容，並視情況採取下列一項或多項措施：
・ 移除或遮蔽相關用戶內容；
・ 限制或終止違規使用者對本服務之使用（包括依裝置識別資訊封鎖）；
・ 視法律要求，向有權機關通報。
基於本服務具暫時性與匿名特性，部分內容在檢舉被處理前，可能已因聊天室到期或系統自動清除機制定期刪除；在此情況下，本公司將盡可能根據剩餘資訊評估風險並採取適當行動。

The Service provides an in-app reporting feature that allows users to flag messages or behaviors they consider inappropriate by selecting “Report Message” or a similar option.
A report may include: message ID, room ID, identifiers of the reported user and reporter, reason for the report, and timestamp, among other data.

The Company will, within reasonable operational limits, review reported content within 24 hours of receipt and may take one or more of the following actions:
・ Remove or hide the relevant user content;
・ Restrict or terminate the offending user’s access to the Service (including device-based blocking);
・ Report to competent authorities if required by law.
Due to the ephemeral and anonymous nature of the Service, some content may be automatically deleted by the system or expire with the room before a report is fully processed. In such cases, the Company will assess the remaining information and take appropriate actions where possible.

7. 資料保留與刪除 / Data Retention and Deletion

為提供本服務運作與安全機制，本公司可能在有限期間內儲存與聊天室及用戶活動相關的技術性資料與紀錄。
如前所述：
・ 聊天室具有約 2 小時之生命週期；
・ 系統層面的聊天記錄將在約 3 小時內自動刪除或無法再被存取。
但在符合法令或合理必要範圍內，本公司仍可能保留部分紀錄（例如檢舉紀錄、封鎖紀錄或法律程序所需之資訊），以便處理濫用行為或配合法律要求。

To operate and secure the Service, the Company may temporarily store technical data and logs related to chat rooms and user activities for a limited period.
As described above:
・ Each chat room has an approximate lifetime of 2 hours; and
・ System-level chat logs are automatically deleted or become inaccessible after approximately 3 hours.
However, within the limits permitted by law and as reasonably necessary, the Company may retain certain records (such as reports, blocking records, or information required for legal processes) to address abuse and comply with legal obligations.

8. 免責聲明與責任限制
Disclaimer and Limitation of Liability

本服務以「現狀」及「可用性」基礎提供，本公司不保證本服務不會中斷、無錯誤或完全安全，也不保證所有不當內容皆能事先被偵測或阻止。
在適用法令許可之最大範圍內，本公司及其管理階層、員工、代理人、關係企業，對於因使用或無法使用本服務所產生之任何間接、附帶、特殊或懲罰性損害概不負責，即使本公司已被告知可能發生此類損害。
您理解並同意，您應自行承擔使用匿名聊天室與用戶產生內容之風險，並應對自己的行為與發言負最終責任。

The Service is provided on an “as is” and “as available” basis. The Company does not warrant that the Service will be uninterrupted, error-free, or completely secure, nor that all objectionable content can be detected or prevented in advance.
To the fullest extent permitted by applicable law, the Company and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, or punitive damages arising from or related to your use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.
You understand and agree that you use anonymous chat and user-generated content at your own risk and remain solely responsible for your actions and communications.

9. 條款變更 / Changes to These Terms

本公司得不時修訂本條款。若本條款有重大變更，本公司將透過本服務或官方網站公告，或以其他合理方式通知您。修訂後之條款自公告或通知時起生效，您於該時點後繼續使用本服務，即視為同意該等修訂。

English:
The Company may revise these Terms from time to time. In the event of material changes, the Company will notify you through the Service, the official website, or by other reasonable means. The revised Terms will take effect upon posting or notification, and your continued use of the Service thereafter constitutes your acceptance of the updated Terms.
